I have been 20 to 25 days late on our loan. They start calling at 8 am 7 days a week. The payment is due on the 1st and late on the 10th. They start calling on the 2nd. We had some extra expenses so I have to wait until checks come in. I mail in my payment about the 25th. I either do not anwswer or just hang up the phone. The people calling read from a script. They know nothing. They are telemarketers.
My home loan is serviced by HomEq and it has been a nightmare. My income has decreased significantly over the last year as a solo practicing attorney and due to family and unemployment circumstances, our credit rating has tanked in the last few years, as well, making a refi near impossible. I have tried on three occasions to obtain a loan modification from HomEq. I meet all the criteria established under the federal government’s making homes affordable program, but somehow, no matter what income I report to HomEq (since I am self-employed, income varies a lot), I get denied. What is most frustrating is that they refused to give me a concrete reason for the denial. They say I “do not meet the financial guidelines.” However, I meet the eligibility criteria established by the government. I have asked countless times for a specific explanation of what exactly the guidelines are that I do not meet and how don’t I meet them (for example, is my income too high or too low; my debts too high or too low, etc.). They refuse to give me an explanation saying that they do not need to discuss their internal policies with me. It is frustrating beyond belief. I am now considering filing a federal lawsuit against HomEq to force them to disclose the guidelines to me and why I was denied. Any other folks out there experience anything similar to this scenario?
Nearly everyone told me NOT to hire someone to work on my behalf in order to modify my load, but I got so frustrated talking to the dirty rotten $#@&^$%&*^ I finally did so. I don’t really know if they of themselves are providing me anything of real value (that is to say, I don’t think they have any power of persuasion), but I don’t have to play the infernal games HomEq seems to like to play with you, especially if you are self employed, as I am. There is a formula (can’t say what that is) and a game. The pro’s who make a living out of promising you a modification certainly have more patience (my guys have been doing this some 10 yrs. Not 10 minutes!) and they seem more dialed in to what HomEq is looking for. After many months and nearly killing myself trying to stick to their “repayment plan”, we may actually be near the end of this nightmare. I’m am quite sure HomEq and who ever the true note older may be, really don’t give a rat’s eye lash who I am, what my family’s needs, desires are. I am convinced of this. We are nothing to them, other than warm bodies who keep them in clover. If we can’t make the grade, so what if they foreclose?!! They’ll find another warm body to put in here and keep the cash cow producing. My opinion is, if you are an attorney and can go ahead and file such a suit, go ahead. It may not save your home, but it might make you feel better. In the mean time, maybe look around for a reputable company, shop around and see who’s been doing this sort of thing a good long while, not a johnny-come-lately to the game. See who can offer you a decent arraignment both price and terms, and let ‘em at it! Couldn’t hurt, and who knows? Might actually work for you. Wish I could be of more help and more positive. But these blood suckers have taken it all out of me. I take some solace in the knowledge that there is a just God in Heaven Who has reserved a special place for people like HomEq. Good Luck!
I have a similar situation. I’m not late on my payment YET…I want to keep my home (the only one), but there is no help. They denied me a loan modification and when i asked the representative for “my option” he recommended a foreclosure or a short sale. That’s the way!
