Reading these logs has made me understand that I am not alone in my fight against the company called Aurora. Like you above, I have been wading through 6 month trial mod plans for the better part of three years, paying on time and staying in constant communication with the hell on earth that is the loan mod dept.
I have been lied to again and again, being told that I’m finally approved for the permanent mod and then once again being told to re-apply for a new 6 month mod plan. It’s driven me upside down on the mortgage. It’s driven me into a new kind of life, one filled with anxiety. I’ve been served papers of eviction/sale twice but have not stopped paying my bill. So I stay here. In a permanent state of pissed off anxiety because no communication with Aurora is effective, succinct or relevant. They lie.
Even the MN Attorney General has helped me and proudly written me a letter showing me that Aurora has approved me once and for all and that it’s all over. This letter was followed by loan mod package that I got notarized and sent back, only to again…yes..again be told that I’m in collections..etc…
Aurora is Hell on Earth. Thank you so much for sharing your pain on this site because it at least makes me feel sane.
We started out with hiring a broker, they sold our home right after we finished our forbearance program. July 2, 2009.Ended up we had to hire a lawyer July 8, 2009.So it has been over a year now.I cannot tell you how many people that I have wrote letters to, but I can tell you it has payed off, I got responce from all the people I wrote to the main person is Office of Thrift Supervision (OTS) they are the Department of the Treasury (800) 842-6929. Their the ones that regulate Aurora Loan Services. Also write the Office Of The Governor, State Capitol, Sacramento, California 95814 (916) 445-2841. Because this is a State matter. I received a responce on March 9, 2010 (second letter) said that their staff has directed our correspondence to the Department of Corporations for review and investigation. I would hear directly from representatives there within the next 45 days.Yes I did hear from them and they told me that they will look into this matter. Matter of fact they called Aurora to find out what was going on and what are they doing to help us and when he finished talking to Aurora he called me back to let me know he was doing a follow up. He told me to call them back if I did not here from them on July 2, 2010. I did here from Aurora not on that date but a few days later they said to give them 20 working days and they would respond to us. It has been over the 20 working days and yesterday August 5, 2010 Aurora called me and told me that they have approved our loan, but she could not say what our payments were going to be as the Mortgage place had our loan and was working on it but our loan payments were going to be higher, the last time they talked to me said our payments were going to be $600 more a month. I thought that modification was to make the payments lower. So now we have to wait and see what they are offering us.Our lawyer will look at all the paper work to see what they are doing. The Department Of Corporations, Business Services and Consumer and Investor Protection Louisa A. Broudy, Deputy Commissioner Financial Services Division (213) 576-7609. They are the people that Arnold Schwarzenegger forward to. Also call OTS and let them know what is going on and you will be signed a case number.Followup on your calls. It seems to me that these two business are the ones to get hold of as the other people they will forward your letter to these people because the other ones say they are not in their jurisdiction over Aurora Loan Services.Aurora Loan Services is an operating subsidiary of Lehman Brothers Band and falls under the jurisdiction of the United State Office of Thrift Supervision (OTS) So please people call, call, call these people enough calls maybe they would do something and believe me they call. When Aurora would call me and they do something to piss me off I write my letters again and send them to these people and let them know they are not telling you the whole truth etc. So when Aurora called me back they told me that they heard from the office of the governor that they aren’t working with us they were upset with me, but I am just telling the truth. On November 30, 2009 they were in the process of rescinded the duly noticed foreclosure sale of our property that occurred on July 2, 2009. And additionally Aurora Loan Services was willing to assist us with exploring available loan workout or home retention options. Well as of this date August 6, 2010 they still have not rescinded our home back to us as they said they have to follow strict guide lines but they did not mention this that letter dated November 30. 2009, they were in the process of rescinding our mortgage loan. Nothing was mention at all about strict guide lines.Where were these strict guide lines when they gave us the loans not only one loan two loans. Keep up your faith and stick with it this is all going to be worth it in the long run.I believe very strong what comes around goes around. Now Aurora is willing to work with us but I’m not giving up and I will still stick to what I believe in and that is getting a fair deal it has been a very long hall and I am here to tell you that I was at some time in giving up thinking is this all worth it. Yes it is worth it all the heart aces tears staying up at night thinking about it. Yes we are very upside down in this loan but some how it will turn around and go our way as long as we are in our home and get it back.
Still waiting Sue Slayton
Sue - I just finished a 6 month successful forebearance plan, and submitted my modfication package. Whammo, Aurora put the Notice of Sale on my door. It is scheduled for next Thursday 8-19. Based on your experience so far, will they go through with the sale, or postpone and put my application into their approval mill? Also, if I were to wire them a payoff amount say 2 days before the sale, do they have to honor it or can they kick it back to me and still sell my home? How in the world have you managed to stay in your home even after it was sold last year? No attempts at eviction?
Thx for all of your knowledge sharing - Donald W
They will go through with the sale. The will lie to your face and tell you they will postpone the sale and then sell your home out from under you. I have filed suit in San Francisco against Aurora for $15,000,000 in damages and I am fighting to stay in my home while I am forcing a jury trial. This is expensive but I refuse to let these scum bags get away with it.
i am in the same position I was forced ins. 3 years ago when I had alreay had ins. it brought my monthly payment from 800 to nearly 2500. I paid 1640 for the month and they said it wasnt enough. I argued that I shouldnt have to pay even that as I have insurance. Then Gmac sold my loan to Aurora and they didn’t apply my insurance to my paynment, instead they said I owed it. They said it could take 2 months to see that I have ins and to adjust the principal. I was put on payment plans. paying 1500 a month, 2000, 1000, 1300 etc… none of it made sense. They then put me on forbearance like 3 times in addition to the 2 previous payment plans. I have been on payment plans for 3 years. i hate Aurora soooo much. When i looked deeper now i realize that the broker I thought was my friend is a crook and I have several illegal infractions on my loan docs. I want to take them to court too. I want to sue for MILLIONS for loss of sleep, depression, loss of relationship, my kids anxiety issues that are so bad they need to be medicated. IT has WRECKED MY LIFE!!! i live in mn contact me please
Hello Donald W -
I just received your comment. I do not know where to start.
Well our lawyer was trying to get the judge to order Aurora to let us stay in our home until we went to litigation but the judge told our lawyer that we were a day to short as the (BIG) head judge told all his other judges under him to go on with the lock out as their were to many people not paying on their mortgage letting the mortgage company think they are keeping their homes but in deed they turn around and walk away from their home.
This was on a Thursday Sept 10, 2009, so I stopped by the lawyers and they told me the bad news that we were scheduled for a lock out on September 15, 2009 at 6:05 Tuesday morning. I thought what else and didn’t know how I even made it home just thinking about Aurora.
Well when I got home a light went on and I told my self no don’t give up yet. I still have some tricks in my bag. So I called the lawyer and told them that OK we want to file for bankruptcy chapter 7 now this was on Thursday after the lawyer told us the judge said we could not stay. So I talked to the lawyer and he told me why did he not think of that that changed everything as it put it on automatic stay. We were forced to file bankruptcy that was the only thing that stopped them from kicking us out.
So my husband and I had to go right down the lawyers office on Friday September 11,2009.We signed some papers to begin the bankruptcy. This was Friday now over the weekend we had to take some courses through Pioneer Credit Counseling and get certified this was done on September 11, 2009. This was the first course. Then our lawyer on Monday September 14, 2009 went right down to the bankruptcy and filed. The last course certificate of debtor education had to be completed by the time we went to court which was completed on October 7, 2009. So we did this on two working days as the sheriff was locking us out of our home on Tuesday September 15, 2009 @ 6:05 a.m. Well they could not touch us as we were in that automatic stay.
But Aurora went to the court to get the automatic stay lifted. On September 27, 2009 Aurora went to the court to have it lifted which they did. But in the mean time through all this I have been writing letters after letter to the President to our Governor etc., who would listen to me.
The only two people you need to reach and here your story is Office of Thrift Supervision, Department of the Treasury Consumer Affairs Division, 1700 G Street, NW Washington, DC 20552. I would send it fax as they will get your letter quicker we even have a case number. OTS is one of their banks they regulate. And the other people you need to talk to is Stat of California-Business, Transportation and Housing Agency Department of Corporations California Investment and Financing Authority, 320 West 4th Street, Suite 750 Los Angeles 90013-2344.
I sent Arnold Schwarzenegger, Governor my story and they contacted me by letter saying that he was honored that I would entrust him with this issue. In order to ensure that my concerns are properly addressed, his staff has directed our correspondence to the Department of Corporations for review and investigation. To allow them within the next 45 days. Well that period expire, and should that time period expire, to please contact his Constituent Affairs which I did I sent my letter again and within a few days I received another letter.
So that is when the Department of Corporations contacted me.They also call Aurora to do a follow up on what they were doing to help us that was about a few weeks ago then they contacted me and told me that they talked to Aurora and that someone was to call me back on where they were on our loan.
If you send your letters to anyone they will tell you that it is out of their jurisdiction to call the OTS office. They did read my story but I’m here to tell you don’t just sit on it waiting to here it will take some time for them to get back with you but they will. They can’t save your home you have to do that but these people will put pressure on Aurora.
But Aurora will send them letters telling them that they are in the process in helping us and that they are in the process of rescinding our home back to us that was sold on July 2, 2009.As of this date August 14, 2010 they have not rescinded our home back to us so when Aurora tells OTS and the Department of Corporations I get mad and send them the whole facts on what they are doing and this hangs up everything. At least this is what is happening to us.
When you send your letters be right to the point I know your mad as hell as we are also but your letter needs to be professional and not angry. You need to be right to the point - yelling and cussing won’t work. I was so surprised that I got responses from these people don’t let your anger take over you I have cried always thinking about our home and what Aurora was going to do next. You need to think on what your going to do.
See OTS and also Department of Corporations forward our letter to Aurora Loan Services so they read my story about them and that is when they started contacting us a Lisa K. Lodge, Executive Communications. Now every one is different stories but don’t give up. Yes we are so upside down in our home but we don’t care we want our home back. Now Aurora is willing to work with us after all this.
But it isn’t over yet. They told us that they are working on trying to get us into a modification program and that were were approved. Well on Friday August 13, 2010 I had to send them more paper work and I faxed over 28 more pages but I get this feeling that yes they approved us for a modification but they are going to make our payments higher then what we are paying so they know that we can not afford the high payments so if we don’t agree they will turn around and say well we offered them and we turned it down but how can you say they are working with us but made our payments higher about $600 or so.
That is why we needed a lawyer but I did all the work not our lawyers but they are getting the credit that we are still in our home. When Aurora sends us their offer I have to take it right down to our lawyers to look over so we don’t get screwed again. This is now up to our lawyers they need to work for their money now. My move is try to keep a step ahead of them and try to think like them on their next move. They have lawyers. I can go on and on on what we are doing but you know it takes allot of prayers night after night, and I asked him to lead us in the right path and it seems like everything we have done in all these steps we have taken we are going in the right direction.
If we don’t like their offer we will just take them to court and let the court decide. See we are just waiting for Aurora to see what they are going to do and if we don’t agree we will go through our litigation which Aurora can not sell our home until it goes to court. They could sell but their is no insurance that would buy the home cause it is in litigation.
So this is the final step no matter how long this takes I will not give in all we want is our home back with reasonable payments and let us live out our years in our home that we love so well. I would not do all this it is so easy to just walk away and start all over again but I will not let them win. I’m here to win and stick with what I believe in so strongly.
I hope this has put some light on you. Aurora can do anything they want look our home still isn’t ours yet the deed is still in their name. I don’t know really how we stayed in our home this long but I believe it has to do with my stubbornness and not letting Aurora to get away with all this this is our home and I will take them down if I have too with allot of other people doing the same thing, and my letters and phone calls. Hope to here from you and I hope you stick with it.
Sincerely
Sue Slayton
Sue,
Through all this, have you asked them to produce the note? Did they have it?
Have you been paying anything toward your mortgage, or have you been holding back?
I’m so glad to have found this thread. I live in Massachusetts and inquired about a modification the day after Obama announced the program in Feb.(?), 2009. I got the run-around for months, but resisted stopping payments, as they suggested, so I’m still sending them $ every month. I gave up dealing with them late last year. Now, all my savings are gone and I must somehow get a re-fi, but I’m unemployed, single and dealing with an illness, so no bank is going to give me a loan.
It’s excruciating to read what they’ve put you through.
I was able to find my mortgage listed online in a passthrough certificate. I’d love to do more research on my loan myself, but this stuff is so dense even lawyers don’t get it. But I am doing as much as I can to figure all this out myself before I hire a lawyer-at least I’ll be able to figure out if whoever I hire knows what he/she is doing.
I look forward to your response to my questions.
I hope you get to keep your home!
Nancy
I’ve owned this property for several years and although it was in great position I moved out and decided to keep it as a rental. Until the inevitable happened,, the market crashed so did the mortgage loan balance… since then had the property as a rental, but renting as a minimum. Had several conversations w/ Aurora to refi before the Obama law but No help or assistance. Several personal situtions have contributed forced me to talked to auraora over and over on to do the Modification. although I’ve sent out and even received a call one time of approval, was denied again for the 4th time. Last time, 5th, I was asked to submit all paper work form IRS for past 3 years back and forth print out , request never asked before.
Just yesterday had a conversation w an officer. new solution, have property for short sale, give back property to aurora or foreclosure.. of course the assistance on modification to help me keep the property was mentioned if I stop making payments. I guess I would like to keep the property with some help without having to stop making payments , but apparently helping owners on good faith is not one of the priorities for Aurora Loans
I would like to know how your agency could help before I proceed with any other decision w/ALS.
Thanks;Mrs ILopez-King
Aurora is the worst. It took me 9 months to get my loan modified. they told me to miss a payment and they will put me on a 90 day trial period while they underight me. They kept losing me paperwork. 3 times i refaxed it! I was ready to kill them. then after they sat on my paperwork for 3months they said the rules have changed and I need to resubmit everything!!! I’m ready to pull my hair out. I finally google around enough to get senior officers names and started call their assistants, my paperwork was misteriously found? hmmmm. I went ahead and signed their papers even though they added all kinds of fees and penalties. They lead you in to it and then try to get rid of you. Hang in there if youre in the process. Find out the key names and start calling the bigshots, otherwise you will never get it done.
I am in forbearance and have paid a reduced payment for 4 months. I am told my modification request is now in the hands of underwriters. I am 2 payments behind because I was told my request for modification would not be considered unless I had missed payments. My income will make the new payment 31% of my gross which I am told qualifies me for modification. I am terrified to read that people are foreclosed upon the day following hearing that their modification was denied. They are given NO OPPORTUNITY TO BRING THE MORTGAGE CURRENT. I have hired an attorney. Is there anyone out there who has goten their modification through?? Any advice or information would be greatly appreciated by this single mother trying to keep her home. Thanks
Do you have their senior officers names? Would you mind to share them as I am trying to get my loan on a rental property modified. Also, has anyone tried to ask them to produce the note?
Thanks
Hello Susan I do not know where to start we have been fighting with Aurora Loan Services for some time now. In 2009 we were on a forbearance program. We finished June 1, 2009 called Aurora tontine out where to send our payments they told me not to send the payment as we were going into the modification. So our broker called Aurora on July 1, 2009 to find out what the status was on our loan the rep told our broker it looked like we were on two differen’t loans one said that our loan was closed as we did not give them our document papers that were missing the other said we were under review. Now earlier in their letter they said that they have received all of our doc how funny they missed place some of our paper work. So on July 8, 2009 our broker called them (Aurora) and asked them what was going on with our loan and they said that our loan was sold on
July 2, 2009. Our broker could not believed they did that said we needed a lawyer so July8, 2009 got a lawyer and I’m here to tell you that I did all the work with writing numerous letters to so many people but the right person to get in contact would be Office of Thrift Supervision Department of the Treasury Consumer Affairs Division 1700 G Street NW Washington DC 20552 also Louisa A Broudy Deputy Commissioner Financial Services Division California Department of Corporations 320 W. street Suite 750 Los Angeles California 90013-2344 Auror recinded our home November 30, 2009. Well as of October 1,2010 Aurora approved a HAMP (Home Affordable Modification Program) Step Rate Loan Modification under the federal government. Do not give up their will be times you just want to through your hands up and say I’m done and walk away don’t give
Up that’s what they want you to do less work they have to do so we are in a three
Months trial period and then it will go into a permeant modification I hope it will work out for you we are about 90% their I did all this without our lawyers we were also forced to file Bankruptcy just to keep our home as we were being evicted on September 15, 2009 @ 6:01 am so on Septmber 11 we filed Bankruptcy which helped us save our home so that I could regroup to
Think ony next move so I just kept on sending my letters also write to the Office of The Governor State Capitol Sacramento California 95814 (916) 445-2841 I could go on and on but I hope this will help you out thinking of you. Sue Slayton
