Is it easier to evict a tenant on a month to month lease than one on a 1 year lease?
Here is the Reader question…I’ll answer below.
“Is it easier to evict a tenant on a month to month lease than one on a 1 year lease?”
My answer:
A tenant is in default of his lease is in default on his lease regardless of the duration of the lease.
So the answer is “No”. A default is a default…plain and simple.
The landlord has grounds to evict or he doesn’t. Therefore it wouldn’t be “easier” to evict on one lease or another based solely on lease duration. Lease duration is irrelevant.
Of course, as in all things legal in real estate please seek a real estate attorney before making any decisions about your home or investment property.
Real estate law is incredibly local, so make sure your legal advice comes from your locale…and preferably owns rental real estate him/her self.
